During a rare Thursday legal update webinar, James M. Morris, our Employment Law and Retained General Counsel Services Team Lead, discussed the effects of the Bills being vetoed by Governor Beshear, and stated that it is a near certainty that the Kentucky Legislature will be able to pass each Bill despite the Governor's veto, as they have enough votes to do so.
James gave an update on the phases of the vaccine and its rollout, as well as a detailed update on the PPP loans and second draws, stating that forgiveness on the second PPP loan will be given if at least 60% is spent on payroll costs. James also gave an update on the Federal Executive Orders and the EEOC regulations, which have a substantial impact on business management and religious discrimination. Additionally, as these companies learned, Kentucky-based businesses need to "dust off" their Human Resources manual, update with "Work From Home" and "Remote Working" Policies and Procedures, and assure compliance with all OSHA, FMLA, EFMLEA, FFCRA and CARES Act requirements.
Employers are entering a dangerous time, as employees will exhaust their available FMLA Leave, and application of FFCRA, EFMLEA, and other recent federal acts and policies must be carefully monitored. As James explained, there is assistance available, and employers can receive a dollar for dollar reimbursement from the Federal Government -- but each Employer must assure full and accurate compliance with Federal Law, or risk the reimbursement that may be available. These critical compliance steps must be undertaken carefully.

The Kentucky House and Senate hold veto-proof numbers, and are seeking to pass over 10 COVID-19 related bills, including allowing businesses to remain open so long as it meets or exceeds COVID-19 guidelines (HB1) and limiting the action that the Governor may take (HB13; HB171; HB217; and HB218) - all of which are nearly certain to be passed.
