On Monday, November 23, 2020, our Employment Law and Retained General Counsel Services Team Lead, James M. Morris, provided a critical update to Kentucky-based businesses regarding Governor Beshear's November 18, 2020 Executive Orders, and the impact of the Business Limitation Executive Order (2020-968) and the School Shutdown Executive Order (2020-269). As explained to the audience of over one-hundred top Kentucky-based businesses, these Executive Orders have a tremendous impact upon Kentucky Businesses. Pursuant to the terms of the Orders, professional businesses must require employees to work from home if they are capable and limit in-person attendance to no more than 33% of capacity, restaurants are limited in types of services that can be provided, gyms, indoor facilities, and venues are drastically limited in scope and numbers. Additionally, as these companies learned, Kentucky-based businesses need to "dust off" their Human Resources manual, update with "Work From Home" and "Remote Working" Policies and Procedures, and assure compliance with all OSHA, FMLA, EFMLEA, FFCRA and CARES Act requirements.
Employers are entering a dangerous time, as employees will exhaust their available FMLA Leave, and application of FFCRA, EFMLEA, and other recent federal acts and policies must be carefully monitored. As James explained, there is assistance available, and employers can receive a dollar for dollar reimbursement from the Federal Government -- but each Employer must assure full and accurate compliance with Federal Law, or risk the reimbursement that may be available. These critical compliance steps must be undertaken carefully.
